Registered Trademarks

Yuta Hayakawa, the operator of ShortWave.STUDIO (hereinafter referred to as the “Trademark Owner”), has registered in Japan the following word mark and logo mark, both created by him and used globally by ShortWave.STUDIO (collectively, the “Marks”).

For as long as the registrations remain in force, the Trademark Owner has, in Japan, the exclusive right to use each registered Mark in connection with the goods and services designated for that registration, and may prohibit certain third-party uses of identical or similar marks in accordance with applicable law.

The registrations may be renewed, in which case their current expiry dates will be extended.


Use of the Marks and Brand Assets

The Marks are trademarks used by ShortWave.STUDIO in Japan and worldwide.

For the purposes of this page, “Brand Assets” means the Marks, icons, designs and other visual or verbal elements used to identify ShortWave.STUDIO, together with the intellectual property relating to them.

The Brand Assets may be used only where such use is expressly permitted by these Guidelines, where separate authorisation has been obtained from the Trademark Owner or another legitimate rights holder, or where use without authorisation is permitted under applicable law.

Nothing in these Guidelines restricts any reference, reporting, criticism, commentary, research or other lawful use permitted under applicable law.

Uses Permitted Without Prior Authorisation

Provided that the use does not create a misleading impression of any affiliation, sponsorship, endorsement, recommendation, authorisation or other official relationship with ShortWave.STUDIO, the ShortWave.STUDIO word mark may be used for the following purposes:

  • Referring to ShortWave.STUDIO in order to convey accurate information
  • Mentioning ShortWave.STUDIO in reporting, criticism, commentary or research
  • Identifying ShortWave.STUDIO content, activities or services where necessary
  • Any other use permitted under applicable law

In such cases, “ShortWave.STUDIO” must be used as a trademark identifying ShortWave.STUDIO, and not as the name of a third party’s own goods, services, business or activities.

Uses Requiring Prior Authorisation

Except where use without authorisation is permitted under applicable law, the following uses require the prior authorisation of the Trademark Owner:

  • Using the ShortWave.STUDIO logo, icons, designs or other visual Brand Assets
  • Using the Brand Assets on or in connection with goods, services, software applications, publications, advertisements, promotional materials or product packaging
  • Manufacturing, selling or distributing goods, clothing, printed materials or other items using the Brand Assets
  • Using the Brand Assets, in whole or in part, as a company name, organisation name, trade name, product name, service name, event name, domain name, account name or social media identifier
  • Stating or implying any affiliation, sponsorship, endorsement, recommendation, authorisation or other official relationship with ShortWave.STUDIO
  • Using the Brand Assets to indicate the source of a third party’s goods or services

Uses That Will Not Be Authorised

The Trademark Owner will not authorise any of the following uses.

This does not restrict any use that is permitted without authorisation under applicable law.

  • Registering, applying to register or asserting rights in the Brand Assets as one’s own
  • Using any name, trademark, logo, domain name or other sign that is identical to the Marks or is likely to cause confusion with them
  • Altering, modifying, animating, reversing, inverting or separating the ShortWave.STUDIO logo into components, or combining it with other text, graphics, images or similar elements
  • Using the Brand Assets in a manner that creates a misleading impression that something has been produced, issued, approved, endorsed, sponsored or authorised by ShortWave.STUDIO
  • Using the Brand Assets in a manner that damages the reputation of ShortWave.STUDIO or the Trademark Owner, or the goodwill or reputation associated with the Brand Assets
  • Using the Brand Assets in a manner contrary to applicable law, public order and morality, or the rights of any third party

Trademark Usage and Attribution

Use of the ™ symbol is optional. The ® symbol may be used only where legally permitted and only in relation to a registered mark.

Where the Brand Assets are used with the authorisation of the Trademark Owner, the following statement must be displayed in a manner that is readily visible and recognisable to third parties:

The ShortWave.STUDIO word mark and logo are trademarks used by ShortWave.STUDIO in Japan and worldwide. The trademark rights in Japan relating to these marks are owned by Yuta Hayakawa, the operator of ShortWave.STUDIO.

Where a different form of attribution is specified in an individual authorisation or licence agreement, the terms of that authorisation or agreement must be followed.

The Marks must be used as trademarks identifying ShortWave.STUDIO.

“ShortWave.STUDIO” must not be used as a generic name for goods, services, content or activities, as a verb, in the plural, or in any other manner that may impair its distinctiveness as a trademark.

The ShortWave.STUDIO logo must not be used as a generic graphic or decorative element, incorporated into another name, graphic or logo, or otherwise used in a manner that impairs its ability to identify ShortWave.STUDIO.


Use of Content

This page governs the use of the Brand Assets.

Nothing on this page grants permission to reproduce, republish, redistribute, modify, reuse or commercially exploit any audio, video, text, images, music or other content published by ShortWave.STUDIO.

Reservation of Rights

Except as expressly stated on this page, nothing in these Guidelines grants any blanket or implied licence in respect of the Brand Assets or any rights relating to them.

All rights not expressly granted on this page are reserved by their respective legitimate owners, to the extent permitted by applicable law.

ShortWave.STUDIO may amend these Guidelines in response to changes in applicable law, the registration status of the Marks or its operational policies.


Language

The Japanese version of these Guidelines is the authoritative version. The English and Traditional Chinese versions are provided for reference only.

If there is any discrepancy or ambiguity between the Japanese version and a translation, the Japanese version shall prevail to the extent permitted by applicable law.
